DISCLAIMER: Seller (House of Scooters, Inc) makes no warranty as to merchantability or fitness for a particular purpose; either express or implied, and disclaims any responsibility for the product when used not as intended or by inappropriate users.
PURCHASER’S RESPONSIBILITY: You must inspect all equipment before using it and to take full responsibility for assuring that the equipment is in good working order and safe to use. You further understand that you are responsible for damage to equipment. Purchaser understands the nature of motor scooter riding and motorcycle related activities and acknowledges that Purchaser is qualified to operate said motor scooter, and is in proper physical condition to participate in such activity. Purchaser agrees to assume all risks when allowing others to operate Purchaser’s scooter.
If Purchaser is not familiar with the nature of motor scooter riding, Purchaser should seek professional training before operating a scooter.
Warranty if voided if product is used in competitive sport, modified, open, rented, and/or ridden by more than one person at a time or used for jumping, stunts or similar activity.
Do not allow others to use the scooter without proper instructions. Ride only in good weather, on smooth surfaces. Remember to always operate your scooter with the proper safety gear and helmet. The scooter is not intended for operation on public streets, roads or highways and should not be operate in traffic of be used by persons unwilling or unable to take responsibility for their own actions. Is not intended for drivers younger than 16 years old.
INHERENT RISKS: Warning! Scooter riding activities involve the risk and danger of serious bodily injury including, but not limited to, disability, paralysis, dismemberment and death. These inherent risks and dangers may be caused by Purchasers own actions or inactions, the actions or inactions of others, participating or not in the activity, the condition in which the activity takes place, or the negligence of others. There may be additional risks, including social and economic loss, either known or unknown to Purchaser, not readily foreseeable, and Purchaser fully accepts and assumes responsibility for all such risks, losses, costs, and damages incurred as a result of Purchaser participation in scooter riding activity.
Operation, Registration and License: Purchaser is responsible for registering and operating the motor scooter in accordance with Local and State Laws and Ordinances. Seller makes no representations that the motor scooter is legal for operation in your City and State. Purchaser must be 18 years of age or older.
HOUSE OF SCOOTERS, INC WILL NOT BE LIABLE FOR ANY INJURIES TO RIDER OR SCOOTER.
Your Insurance Policies may not provide coverage for accidents involving the use of this scooter. To determine if coverage is provided, you should contact your Insurance Company or agent.
49 CC SCOOTERS AND OVER: 60 DAYS OR 1000 MILES WARRANTY whichever comes first. PARTS ONLY, LABOR IS NOT COVERED.
LESS THAN 49 CC AND ELECTRIC SCOOTERS: 30 DAYS FROM PURCHASE DATE, PARTS ONLY, LABOR IS NOT COVERED.
THE SCOOTER IS SOLD WITH ALL FAULTS.
THIS LIMITED WARRANTY ONLY COVERS THE FOLLOWING PARTS:
Any part that proves defective by reason of improper workmanship or materials. This warranty is explicit to manufacturer’s defects only.
Items NOT covered by any warranty at any time are: tires, wheels, wheel bearings, belts, chains, horns, lights, mirrors, plastic components and accessories.
COVERAGE AND LIMITATIONS
IMPORTANT: You must have a professional mechanic (any small engine repair shop, motorcycle shop, or local auto repair shop) to assemble your new scooter and do the prep work to assure your scooter is in good working condition or your warranty is only 45 days. You will need to provide proof when filing a warranty claim, so please keep your receipts. You must also have a professional work on your scooter to file a claim on the warranty.
REPAIRED COMPONENTS: If the components are repaired under the terms of this Agreement they will be repaired or with components parts of like kind and quality.
LABOR TO REPAIR OR REPLACE PARTS: The Buyer must pay for labor for the removal and replacement of such component(s) or part(s).
IMPORTANT NOTES
This warranty does not include labor, wearable parts or damaged parts from accidents, abuse, or shipping. If you have a part that needs replacing, please contact us and we will send the part within 10 days if available, or let you know the lead time for the part. In some cases, the parts, may have to be shipped from China and may take up to 8 weeks for delivery. The Buyer must pay the delivery costs.
House of Scooters, Inc reserves the right to have inspection of the component(s) or part(s) covered by this Agreement prior to any repair or replacement of or reimbursement for such component(s) or part(s) is authorized.
RETURNS: Customer may return the scooter within 7 days of purchase with valid receipt or proof of purchase. No returns will be accepted once scooter has been used.
The scooter must be returned in the original container with all accessories, manuals and packing. House of Scooters, Inc is not responsible for the cost of shipping in case of return. In addition, original shipping and handling costs are non refundable.
There will be a 30% restocking fee on all returns.
THIS AGREEMENT AND LIMITED WARRANTY IS VOID IF House of Scooters, Inc is not provided a reasonable opportunity for inspection of a covered component prior to removal, repair of replacement of any covered component. The customer does not use a professional mechanic or an authorized dealer to assemble and prep the scooter prior to operation. Proof of this will be required before parts will be replaced. The components are not installed by certified licensed repair facility or an authorized dealer within 45 days of the date of purchase as indicated on this agreement. The damage to the component is caused by a non-covered component of part or by any part or component not purchased from House of Scooters, Inc. The customer failed to follow the minimum maintenance and a brake-in requirement suggested by the manufacturer, and fails to provide proper service documents. Warranty is void if heat tabs are melted.
LIMITED WARRANTY TRANSFERABILITY
This Agreement is provided to the original Purchaser and is non transferable. This agreement does not cover damage due to misuse, neglect, or accident.
NO IMPLIED WARRANTIES OR AGREEMENTS: THERE ARE NO AGGREMENTS OR WARRANTIES, EXPRESSED OR IMPLIED INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE STATED IN THIS AGREEMENT. HOUSE OF SCOOTERS, INC SHALL NOT BE RESPONSIBLE FOR THE PAYMENT OF DAMAGES, OTHER THAT THE SUMS SPECIFIED IN THIS AGREEMENT AND LIMITED WARRANTY, FOR INCIDENTAL OR CONSEQUENTIAL LOSS OR DAMAGE ARISING FROM INJURY, LOSS OF USE, LOSS OF TIME, RENTAL VEHICLES, PROFITS, OR INCOME TO THE CUSTOMER AS A RESULT OF A FAILURE OF ANY COMPONENT OF PART.
All towing charges incurred are the responsibility of the customer. There are no other agreements between the parties with regards to the components purchased except as stated in this agreement and limited warranty.
HOUSE OF SCOOTERS, INC DISCLAIMS ALL OTHER WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING THE WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

By clicking 'submit order', or purchasing any of our products, you constitute your understanding and acceptance of all of our policies and agree that they constitute a legally binding agreement. Any ambiguous language in this agreement shall be interpreted as to its fair meaning and not strictly for or against any party. Arbitration: Any controversy, claim or dispute arising out of or relating to this agreement, shall be settled by binding arbitration in Hollywood, FL. Such arbitration shall be conducted in Hollywood, Florida and governed by the then prevailing commercial arbitration rules of Florida law, with the following exceptions if in conflict: a) one arbitrator shall be chosen by House of Scooters, Inc. (b) The non-prevailing party shall be responsible for the expenses and fees of the arbitrator, together with other expenses of the arbitration incurred or approved by the arbitrator; and (c) arbitration may proceed in the absence of any party if written notice has been given to such. The parties agree to abide by all decisions and awards rendered in such proceedings. Such decisions and awards rendered by the arbitrator shall be final and conclusive and may be entered in any court thereof as a basis of judgment and of the issuance of execution for its collection. All such controversies, claims or disputes shall be settled in this manner in lieu of any action at law or equity. The arbitrator shall not have the right to award punitive damages or speculative damages to either party and shall not have the power to amend this agreement. The arbitrator shall be required to follow applicable law. [IF FOR ANY REASON THIS ARBITRATION CLAUSE BECOMES NOT APPLICABLE, THEN EACH PARTY, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HEREBY IRREVOCABLY WAIVES ALL RIGHT TO TRIAL BY JURY AS TO ANY ISSUE RELATING HERETO IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THIS AGREEMENT OR ANY OTHER MATTER INVOLVING THE PARTIES HERE TO. Any and all attorneys' fees will be the responsibility of the non-prevailing party. All claims or disputes must be filed within Hollywood, Florida. Sever ability of Agreement: If any term or provision of this agreement is determined to be illegal, unenforceable, or invalid in whole or in part for any reason, such illegal, Unenforceable or invalid provisions shall be stricken from this agreement, and such provision shall not affect the legality, enforceability, or validity of the remainder of this agreement. If any provision or part thereof of this agreement is stricken in accordance with the provisions of this section, then this stricken provision shall be replaced, to the extent possible, with a legal, enforceable, and valid provision that is as similar in tenor to the stricken provision as is legally possible.
Modification of Agreement: This agreement may be supplemented, amended, or modified by House of Scooter, Inc at any time. Supplement, amendment, or modification of this agreement will be binding by all parties.
